Welcome to the Georgia Conservation Voters Legislative Newsletter. This letter will be circulated frequently during the 2006 legislative session in efforts to keep you abreast on issues of particular interest to you on environmental legislation.

 Income Tax Credit for Land Conservation
 House Bill 1107

Picture of Capitol Last week, Representatives Roberts, Golick, V. Smith, Maddox, L. Smith, and Lewis unveiled House Bill 1107, known to many of us as the Land Conservation Tax Credit. This bill provides for a 25% state income tax credit up to $250,000 for individuals and $500,000 for corporations who place their land in a permanent conservation easement or a qualified donation to state, county or municipal governments, or a charitable nonprofit organization.

This bill, championed by the Governor and supported by the general environmental community, is modeled on a land conservation tax credit implemented in North Carolina in 1983. Since its implementation, the tax credit has helped North Carolina permanently conserve almost 140,000 acres of valuable land at a cost to the state of less than 17% of the outright purchase value.

The bill is on agenda at the Income Tax Subcommittee meeting on Tuesday, January 31, 2005 at 8:30 A.M. in Room 133 of the Capitol.

 Rulemaking Process of EPD
 David Word Addresses Committee

EPD logo On Thursday, January 26, the Assistant Director of the Environmental Protection Division, David Word, gave a presentation to the Joint Natural Resources and Environment Committee meeting regarding the rulemaking process of the division. This presentation, entitled “Promulgation of Agency Rules and Regulations,” was part of the continuing education Joint meetings that have thus far included a presentation by R. Harold Brown on his book, The Greening of Georgia. For those interested in EPD’s rulemaking process the list of proposed rules and general format for rulemaking can be found at the following link under the 'rules and laws' link.

 EPD Supplementary Budget
 Funding of HWTF to Enable Clean-up

Hazardous Waste Last week the House Appropriations General Subcommittee met to hear supplementary budget requests by the Environmental Protection Division, as approved by Governor Perdue. Among budgetary issues discussed was the full funding of the Hazardous and Solid Waste Trust Funds. If granted, the increased revenue from the Hazardous Waste Trust Fund would amount to $8.3 million and would enable EPD to reimburse 104 local governments for previous expenditure to clean up hazardous waste sites in their areas.
