 Stream Buffers Bill On the Move
 SB 510 Substitute Passes Committee

pearson The Senate Natural Resources and Environment Committee met Thursday, February 23rd to vote on the bill that met with much opposition in its hearing one week before. Senator Chip Pearson amended his bill and removed the most onerous provisions, in no small part due to the public outcry against the blatant attack on stream buffers across Georgia. The bill's scope is now narrowed to 150-foot stream buffers that protect streams within seven miles upstream from a drinking water reservoir. The bill now provides a variance process, managed by EPD, for intrusion into those buffers.

That said, the bill is still dangerous. It provides for an exemption to stream buffers for a single dwelling on 2 acre or larger tract and has a glaring loop hole: an exemption to all buffers if a local government adopts a storm-water management ordinance. It is unclear whether such an ordinance could even be created, and even if it could, there is the potential that such an ordinance would not be enforced by a local government. Such ordinances are only as good as their enforcement, and the track record for local governments' enforcement of stormwater ordinances and buffer-related ordinances is less than stellar. The environmental community is prepared to fight this bill on the Senate floor sometime this week. Please stay tuned for updates and a GEAN alert urging Senators to VOTE NO to SB 510.

 Nongame Wildlife Conservation Fund Under Assault
 House Bill 1232 Passes Committee

nongame House Bill 1232, threatening the status of the Nongame Wildlife Conservation and Wildlife Habitat Acquisitions Fund, was heard in the House Motor Vehicles Committee on Tuesday, February 28th. This bill proposes re-assigning funds from the sale of nongame wildlife license plates to the general fund of the state treasury and not into the Nongame Wildlife Conservation and Wildlife Habitat Acquisitions Fund.

This reallocation of funds would be devastating to the fund. Since the introduction of nongame wildlife license plates in 1997, they have provided 76% of all revenue in the Nongame Wildlife Conservation Fund. Furthermore, House Bill 1232 breaks faith with citizens who purchase the special nongame license plate to support wildlife conservation because it allows the allocation and use of nongame funds for other purposes. The Board of the Georgia Department of Natural Resources passed a resolution on February 22, 2006 opposing the bill. House Bill 1232 will be voted on in the near future. We will follow up on this issue at that time.
